Realians have human rights in the Xenosaga universe, so I believe banging a realian designed to emulate an underage girl would probably constitute the realian equivalent of statutory rape.
But that makes one wonder; would the designers really include such a superfluous feature such as sex organs? I look at Ilfa in To Heart 2 and find it hard to believe she has her own h-scenes in the xrated version.
Sex organs are what makes a Gynoid a Gynoid and an Android an Android. Sure, there's those that just have the general 'form' of a male or female, but then again those aren't designed with, y'know, skin and squishy bits like a realian.

In Momo's case the answer is yes. The database from Ep. III says that she's also a transgenic type realian and can someday have children if she wants. In her case though the man who created her (her father) wanted her to have a normal life, and procreation is part of a normal life for many. (IIRC, the database seems to imply that she'd need a new body before she'd be able to actually get pregnant, one that's based on an older female. It's not entirely clear if that's an absolute requirement or not, it could simply be that she might prefer to do so.)

I don't know why it surprises you, they already make life-sized sex dolls, there would be people who would want gynoids they could have sex with and if there's a market for it in general it'll happen. (Even illegal stuff, that just goes on underground and mostly out of sight.)
It all depends on how you want to slice the cake. If you want to discuss only the art, then MOMO counts as any object of pubescent desire--she can be the object of ephebophilic fantasies.
If you want to treat it as if you were in the Xenosaga universe, then it might get a bit more complicated. Age-of-consent laws are formulated based on the assumption that persons beneath a certain age cannot fully understand the consequences of their actions. Of course, since realians neither age nor are they born, that standard would quickly become obsolete--it's now a matter of whether her mental state is fit to give consent in Xenosaga law.
That might a sticky problem, not to mention the fact that people might look at you strange for desiring a twelve-year-old (if in appearance only).
It wasn't so much in Xenosaga context as it is real-world context, considering fully-equipped Gy/Androids are an inevitability. Hell, I fully expect to be a Cyborg and cheat death somewhat by the time I'm old enough to die.

Though, this doesn't really answer the question if said gynoid in question is, say, anatomically 14-16 but has a build date of 50 years ago. This has to make one ponder: What is age?
The problem is that since she comes from the Xenosaga universe there simply isn't a yes or no answer. Questions like "what is age?" are pretty minor among much of the concepts Xenosaga brings up and makes you think about. Those include "what is life?" "what does it mean to be alive?", "how do you decide what deserves the same rights as humans?", and so on. I think they made Momo intentionally confusing in age just to throw in some more quandries for people to ponder.
Now outside the Xenosaga universe I would say that most people would consider it ephebophilic if the gynoid in question appeared to be 14-16. We will certainly have to figure out the answers to that once we get to where we can create gynoids that are "fully functional" and I expect that the debate will be a very messy one.
MOMO has close to thirteen years of activity, and she's been active pretty much since the moment she was finished. She may not age, so she would eventually be a fifty-year-old still looking like a little girl, but by the end of Xenosaga III she is still both legally and biologically underage. I suppose you can throw Jr. in with Albedo on the paedophile thing, Jr. is even older.
And Ephebophilia is attraction towards prepubescent figures. Even if she were a hundred years old, if the body (which is that of a child) still turns you on, it's still ephebophilia.
