Nintendo is generally pretty slow on the uptake from the fandom, but I can't imagine they're so deaf that they won't hear how much clamor this caused.

That said, I'm not sure how much they're going to be willing to do about this. Virtually anything LGBT seems WAY outside Nintendo's comfort zone. They pretty much retconned Birdo's backstory, and there was that whole Tomodachi Life thing.

Even before that, the Mario 'verse (for as much as it has enough regard for continuity to be called such) has generally had a serious problem adding in female characters of any sort, with even games like Paper Mario basically just declaring all gender-nonspecific characters male, and making the girl versions all pink or just slapping a bow on it (Toadette, Wendy Koopa, Bombette, Miss Bow, etc. being prime examples). Straight-up giving out gender-bending items to anyone and everyone seems way past what they'd be willing to do.

At best, I'd see a joking nod to the idea. I.E. maybe a Disgaea-style "turned into a girl for a day" for Bowser, but nothing coming of it besides being embarrassed, stomping, and spitting fireballs.

If "Princess King Boo" gets really popular, though, I can certainly see them introducing some (always female) Boo-"species" character to become a Princess Boo, or the aforementioned Lady Bow or maybe Kammy Koopa being brought back.

I mean with pokemon there is nothing stopping you from having a male pokemon and using him for contests and dressing the ever loving fuck out of him in all the frills and ribbons you can afford.

There was also the legend of zelda what with you having to crossdress in order to get into a major town for the plot.

Crossdressing for infiltration plot purposes is generally treated as a joke, and the lowest on the rankings of nods to LGBT issues. (Especially if the whole joke is "that's not something men are supposed to do!"... which kind of flies in the face of actual trans people, you know?) Bugs Bunny kissing Elmer Fudd on the lips after wearing a dress was a joke back in the '30s, and it's not like that was pioneering gay rights or anything. For that matter, Cloud crossedressed in the very first game Squaresoft did after jumping ship from Nintendo, and that was two decades ago, so it's still pretty far behind the curve.

As for Pokemon, that's because they're treated as animals. That's like saying that Nintendogs letting you dress a male poodle up with a bow counts as crossdressing.

Which comes back to what I said - they'd at most have a "transformed for a day" joke plot, with MAYBE a joke about the koopa troopas falling in love with Princess Koopa, but they're not going to run with it anywhere near as far as the fans have been clamoring with things like a Mario-Bowser or ESPECIALLY a Peach-Bowser yuri romance plot. (And for the record, what I'd most want to see - especially in a Paper Mario-style more plot-driven game - would be some sort of tsundere Bowser gentleman Mario accidental romance tease.)

Beyond any potential LGBTQ issues, there's the simple fact there's no way in hell Nintendo'd use a fan character for various reasons including licensing, and it'd be quite hard to design their own take on the concept without risking copyright issues. Simply put, it's a character they don't control.

They could, all they need is just pay ayyk92 and have him sign the rights over.

Heck, they prolly don't even need to pay him (or ask), because the character is derivative anyway (based on Bowser and Peach), so most (if not all) of the rights over the character would still default to Nintendo, fan character or no. And they have the lawyers.

It'll just be a bad idea though, from an ethics and publicity point of view.

Well they did send a C&D to AM2R only to do Samus Returns, so they have seen a trend then capitalize on it on their own terms.

I'm not sure why they'd be too scared. I mean, the "original" Bowsette was part of a fanart of their own copyrighted characters whose likenesses were used without permission, so Ayyk92 wouldn't have a legal leg to stand on if he even wanted to sue Nintendo. (And if anything, Nintendo could sue him, considering how spitefully they've been trying to rob YouTubers.) It'd be like the Sonichu guy actually trying to sue someone for 'stealing' his 'original character' to stop someone from posting mockery of his work. Bowsette is literally and deliberately nothing more than a mash-up of two copyrighted characters, both of which Nintendo owns.

Even if there were some room for claiming original creative property for that specific character design, it would only then be for that specific design, and have to be construed in a very narrow fashion, the way that, for example, clothing copyrights are extremely narrow to the point of really only protecting the logo. If Nintendo so much as changed the earring design, they'd probably be able to claim it their own work based upon their own previously-held copyrights.

Also, part of the EULA on Twitter states that posting artwork on Twitter voids your copyright claims, which means that anyone can use artwork found on Twitter (so long as it was uploaded by the original artist) for commercial purposes as though it were public domain, which makes it available for commercial use, so even straight-up using the original artwork posted on Twitter would be fair game.
