Yeah, I'm familiar with the similarity, but the angle of the strokes still makes the kana look like ン rather than ソ to me. And since it's こそ泥 vs. 泥棒, I'd say "sneak thief" is a bit more accurate than just "thief" (though just "thief" is punchier).

If you think of it in terms of brushstrokes, especially when written with a brush, then it's a bit easier to tell that it's "so" (right stroke is thicker on top, thinner on bottom) with this font and other similar ones.
