Regarding the specific provisions of the ToS and other issues

Comment Spam was leading into a discussion regarding the ToS.

I don't want to get it too off-topic so here's this thread.

1.) The specific provisions, to some, aren't helpful.

2.) There is some disagreement on what to do with ToS images. I've seen some say that they should all be zapped, others that its case by case, but the problem with the latter is that there is further disagreement on who has the ultimate authority to make the decision that its good enough to keep.

You are making it sound like I reapproved a shitload of images, but the truth is that even when I was active, I reapproved like 10, maybe 20 ToS violaton pics, specifically Usatarou and other quality artists'.
Now, I don't care if danbooru doesn't want to allow gigantic breasts or huge penises or guro anymore, but either completetly ban them or make it like it was a while back, simply taking some extra care on approving that kind of pics and only allowing quality stuff (just an example: usatarou, in my and im pretty sure many other's opinion, is quality)

Policy so far has been to treat things on a case by case basis. While violating the ToS is a huge negative for a post's approval chances, and greatly increases (and completely justifies) the chance for something to be flagged and deleted, having flexibility is a good thing and allows images that otherwise have extraordinary merit, or that only barely violate the ToS to be retained.

As for authority, generally it should work the same as usual: one person with the authority to post unmoderated content or to approve content makes a judgment call that the rules should be bent in a specific case. If people disagree with that judgement call, it gets flagged for deletion and goes through the moderation queue where a second person's judgment is required to keep it.

Although not technically impossible as of right now, it is poor manners and policy for the original uploader or approver to simply re-approve a flagged image.

The primary problem brought up in forum #37767 was when someone with the ability to approve images repeatedly and inappropriately abuses their ability to bend/break the rules, or does go ahead and frequently overrules flags called on posts they themselves uploaded or approved.

In that case, the matter should be brought up in the forums and discussed, so that the accused party can be confronted and remedial actions taken if necessary. That's basically what happened in this case (although it really should have been given its own thread rather than hijacking an unrelated one).

I don't want strict enforcement. There will always be exceptions.

I take a pretty lazy attitude about this. 40-50 bad posts for a banned tag is not a big deal. The primary intent of those huge breast/guro bans is to prevent flooding.

I agree there are flaws in the approval system that allow janitors with fringe opinions to approve a lot of shit. It's my opinion though that it hasn't adversely affected the average quality of approved posts, simply because there's so much of it now.

I know I have my share of almost-breaks-the-rules art that I really like that's on this site. But I know that it represents an infinitesimal fraction and that it probably doesn't bother most people, because odds are they'll never see it. I feel that all the janitors should enjoy the same amount of leeway in the stuff they approve, provided they understand which posts explicitly break the rules and they moderate their own approvals so that only the best 5% of the rulebreakers get through. I'm totally fine with this.
